Defendant sought review of the judgment of the Circuit Court of Loudoun County (Virginia), which convicted him of driving under the influence (DUI), third offense within ten years, in violation of Va. Code Ann. § 18.2-266, and driving on a suspended or revoked operator's license. Defendant contended that the trial court erred in denying his motion to strike the evidence on the DUI charge..

            The Virginia Court made the following holding:

  • To obtain a conviction for driving under the influence pursuant to Va. Code Ann. § 18.2-266(i), the Commonwealth must prove that the accused was operating a motor vehicle with a blood alcohol content of 0.08% or higher. The "as indicated by a chemical test" language in this Code section provides the basis for a permissible inference that the blood alcohol concentration while driving was the same as indicated by the results of the subsequent test. Section 18.2-266 does not establish a mandatory presumption but allows only a permissive inference that the fact finder is free to reject...
