Facts:
Following a bench trial in
the Circuit Court of Loudoun (Virginia) defendant was convicted of driving as a
habitual offender, second or subsequent offense, in violation of Va. Code Ann.
§ 46.2-357(B)(3), and driving while under the influence of alcohol (DUI) in violation
of Va. Code Ann. § 18.2-266. Defendant appealed.

The
Virginia Court made the following holding:
- When the offense is a
felony and the trial court enters a nolle prosequi of the felony
indictment, it lays to rest that indictment and the underlying warrant
without disposition, as though they had never existed. After a nolle
prosequi of an indictment, the slate is wiped clean, and the situation is
the same as if the Commonwealth had chosen to make no charge. When the offense is a
misdemeanor and the charging document is a warrant, a nolle prosequi wipes
the slate clean, and the situation is the same as if the Commonwealth had
chosen to make no charge.
